Terms of service.

1. Service overview

WestForge Systems provides Minecraft server hosting, setup assistance, and account access tools through a managed panel environment. Services are provided for lawful use only and are intended for game communities, testing, and related projects.

Service features, limits, and delivery methods may change over time due to infrastructure upgrades, security improvements, supplier changes, legal obligations, and business operations.

2. Eligibility and acceptance of terms

• By ordering, paying for, or using any service, you confirm that you have read and accepted these terms.
• You must be legally allowed to enter into a service agreement in your country or region.
• If you are under the legal age in your region, use of services must be supervised or approved by a parent or legal guardian.
• If you do not agree to these terms, you must not use the service.

3. Orders and account information

• You must provide accurate information including your name, contact details, selected plan, preferred server settings, and billing details.
• Setup can be delayed or paused if required information is missing, incorrect, or cannot be verified.
• You are responsible for keeping account contact information up to date so billing and security notices can be delivered.
• You are responsible for all activity that occurs from your account credentials unless unauthorized access is reported promptly.

4. Payments, billing cycles, and non-payment

• Payments are accepted through PayPal only.
• Services are prepaid. Setup starts after payment is confirmed and required details are submitted.
• Plans may be offered monthly, quarterly, yearly, or custom by written agreement.
• Failure to pay renewal charges by the due date may result in suspension, restricted access, or termination.
• Late payments do not guarantee recovery of deleted data or reinstatement of service.
• Payment records from PayPal are considered the primary payment proof.

5. Refund policy

All sales are final. No refund will be provided for a removed, suspended, terminated, or blacklisted service, including if you paid for 1 year or more of hosting.

• No refund is required where these terms are breached or where service abuse occurs.
• No refund is required for downtime, lag, third-party outages, or events outside reasonable control.
• No refund is required where chargeback abuse, dispute fraud, or payment reversal behavior occurs.
• If a refund is granted as an exception, processing fees and already delivered service time may be deducted.

6. Setup scope and support scope

• Setup assistance includes standard deployment, launcher compatibility guidance, and basic server adjustments where possible.
• Support response times may vary by queue size, timezone, and issue complexity.
• Support does not guarantee custom development work, unlimited revisions, or immediate response.
• Plugin packs, modpacks, custom code debugging, and third-party scripts may be declined at the provider's discretion.
• Abusive behavior toward support staff may result in reduced support priority, suspension, or account removal.

7. Acceptable use policy

• Servers must not be used for illegal activity.
• Servers must not be used for harassment, abuse, extortion, scams, malware, phishing, or security attacks.
• You must follow relevant laws and any rules that apply to the game, platform, payment processor, or hosting provider.
• You must not attempt to damage, overload, bypass, or interfere with hosting infrastructure or management systems.
• You must not run services that expose unauthorized network proxies, botnets, cryptominers, or exploit frameworks.
• You must not host material that infringes intellectual property rights or violates privacy rights.

8. Fair use and resource limits

• CPU, RAM, disk, network, and backup usage must remain within your plan limits or approved custom limits.
• Repeated overuse that impacts infrastructure or other customers may result in temporary throttling or required plan upgrade.
• Abusive high-load behavior may result in immediate suspension where service stability is at risk.

9. Security responsibilities

• You are responsible for maintaining secure passwords and access practices for all panel and game accounts under your control.
• You must promptly report suspected account compromise, token leakage, or unauthorized panel access.
• WestForge Systems may require credential resets or temporary restrictions if suspicious behavior is detected.
• You are responsible for software vulnerabilities introduced by files, plugins, mods, or scripts you upload.

10. Suspension, termination, and blacklist

• Services may be suspended, restricted, or terminated if these terms are breached, payments fail, or security risks are identified.
• Serious abuse, fraud, illegal use, repeat violations, or harmful conduct may result in permanent blacklist status.
• Immediate action may be taken without notice where necessary to protect users, systems, legal compliance, or provider relationships.
• Termination does not remove your payment obligations for service already delivered.

11. Backups and data retention

• Backups may be provided by plan allocation, for example one backup slot on Forge Lite and Forge Standard and three backup slots on Forge Elite unless changed by later plan updates.
• Backups are a convenience feature, not a guaranteed disaster recovery system.
• You remain fully responsible for keeping your own external copies of important data.
• Deleted, corrupted, or overwritten data may not be recoverable, including after suspension or termination.
• Data on inactive, expired, or terminated services may be deleted without notice after a retention window determined by operations needs.

12. Availability, maintenance, and incidents

• Reasonable efforts are made to keep services stable and available, but uninterrupted uptime is not guaranteed.
• Maintenance windows, emergency fixes, provider incidents, attacks, and hardware or software faults can affect availability.
• Service credits are not guaranteed unless explicitly confirmed in writing for a specific incident.

13. Third-party dependencies

• Services rely on third-party providers including but not limited to infrastructure providers, DDoS mitigation providers, software vendors, and payment systems.
• WestForge Systems is not liable for outages, policy changes, bans, service limits, or failures caused by third parties.
• Third-party terms may apply in parallel and must be followed by all users.

14. Intellectual property and content responsibility

• You retain ownership of your original content, but you confirm you have the rights needed to upload and host that content.
• You grant a limited technical permission for WestForge Systems to process, store, and transmit your content only as required to deliver the service.
• You must not host unauthorized copyrighted files, stolen assets, or unlawful personal data.

15. Privacy and logs

• Operational logs and limited account metadata may be retained for security, billing validation, abuse prevention, and service diagnostics.
• Reasonable measures are used to protect account information, but no online system can be guaranteed fully secure.
• Information may be disclosed where legally required or where necessary to investigate abuse, fraud, or security incidents.

16. Limitation of liability

• Services are provided on an as-is and as-available basis.
• To the maximum extent permitted by law, WestForge Systems is not liable for indirect losses, lost revenue, lost profits, lost opportunity, data loss, account damage, or business interruption.
• Total liability, where legally unavoidable, is limited to the amount paid by you for the affected service period.
• You remain responsible for all usage, files, and actions performed through your server and account.

17. Indemnity

• You agree to indemnify and hold WestForge Systems harmless from claims, damages, penalties, and costs resulting from your content, server behavior, legal violations, or breach of these terms.
• This includes claims brought by third parties, platforms, infrastructure providers, or authorities caused by your use of the service.

18. Force majeure

• WestForge Systems is not responsible for failure or delay caused by events outside reasonable control, including natural disasters, war, civil disruptions, internet outages, utility failures, provider failures, cyber attacks, and legal restrictions.

19. Changes to services, terms, and pricing

• Terms, service features, support scope, and prices may be modified at any time to reflect operational, legal, or market changes.
• Updated terms apply from the published effective date and continued use means acceptance of updated terms.
• If you do not agree to updated terms, you may stop using services at the end of your active paid period.

20. Governing law and dispute handling

• These terms are governed by the laws applicable to the service operator's primary operating region unless mandatory local law requires otherwise.
• Before starting formal legal action, you agree to first contact support and attempt to resolve disputes in good faith.
• If resolution is not reached, disputes may be handled in the courts with proper jurisdiction over the operator or as otherwise required by law.
